Terms and Conditions

These terms of service are a binding legal contract between you and Corporación QRE, Sociedad Anónima governing the right to use the website, applications and other platform offerings.

The Corporación QRE, Sociedad Anónima website is intended to provide services to people within the territory of the Republic of Guatemala. These services include: the purchase, sale and leasing of real estate of all kinds: residential houses, offices, shops, apartments, land, and so on.

In order to use the services of the site, you must provide personal information such as: your full name, Unique Identification Code, phone number, email address, among others.

Authorization to Promote Properties

By providing the above information, I declare that I am the legitimate owner or possessor of the identified real estate and I authorize Corporación QRE, Sociedad Anónima to promote the sale and/or lease of the property through any means of dissemination, whether digital or analog. Digital media is understood to include: web portals, social networks and any digital ecosystem.

Information Safeguarding and Personal Data Protection

Corporación QRE, Sociedad Anónima may store your data in its own databases for an indefinite period and reserves the right to discard or update it whenever it deems appropriate and in accordance with the Guatemalan legislation in force in the matter (Article 30. Habeas data: Public Information Access Law). Under no circumstances shall Corporación QRE, Sociedad Anónima market or share your data with third parties without express consent (Article 31 Public Information Access Law). Data is collected for statistical purposes and to verify your identity when you request our services.

Under no circumstances may databases or files be created with sensitive data or sensitive personal data, except when used for the service and care provided by Corporación QRE, Sociedad Anónima itself.

Fee Terms

For the sale of urban properties: Corporación QRE, Sociedad Anónima will receive a commission of five percent (5%) of the actual sale value. For rural or distant properties, a commission between five percent (5%) and ten percent (10%) may be agreed upon depending on the distance, nature and accessibility of the property, etc. In all cases, Corporación QRE, Sociedad Anónima is authorized to request payment directly to itself and to deduct it from the total value, and the corresponding Value Added Tax (VAT) on the fees must also be paid.

For the leasing of properties: Corporación QRE, Sociedad Anónima will receive a commission of ten percent (10%) on the monthly rent for contracts of one (1) to six (6) months; eight point thirty-three percent (8.33%) on the monthly rent for contracts of six (6) to eleven (11) months. For contracts of one (1) to five (5) years, the commission will be equivalent to one (1) month of rent. For contracts of five (5) to ten (10) years, the commission will be the value of two (2) months of rent. For contracts of ten (10) to fifteen (15) years, three (3) months of rent, and for contracts of sixteen (16) to twenty (20) years, four (4) months of rent.

Jurisdiction

The legal provisions mentioned above for the Corporación QRE, Sociedad Anónima website are in force throughout the Republic of Guatemala and are fully aligned with Guatemalan legislation on personal data and access to information.

I accept that a real estate agent from Corporación QRE, Sociedad Anónima may contact me by phone or by using text messaging services, including through automated means related to real estate services, in order to access real estate services.

I accept that Corporación QRE S.A. takes photographs and video of the property to be promoted.
